The present time, likewise, is that peculiar time, which never happens to a nation but once, viz., the time of forming itself into a government. Most nations have let slip the opportunity, and by that means have been compelled to receive laws from their conquerors, instead of making laws for themselves. First, they had a king, and then a form of government; whereas, the articles or charter of government, should be formed first, and men delegated to to execute them afterwards: but from the errors of other nations, let us learn wisdom, and lay hold of the present opportunity -- to begin government at the right end.

When William the Conqueror subdued England he gave them law at the point of the sword; and until we consent that the seat of government in America, be legally and authoritatively occupied, we shall be in danger of having it filled by some fortunate ruffian, who may treat us in the same manner, and then, where will be our freedom? where our property?

But where, says some, is the King of America? I'll tell you Friend, he reigns above, and doth not make havoc of mankind like the Royal Brute of Britain. Yet that we may not appear to be defective even in earthly honors, let a day be solemnly set apart for proclaiming the charter; let it be brought forth placed on the divine law, the word of God; let a crown be placed thereon, by which the world may know, that so far as we approve of monarchy, that in American the law is king. For as in absolute government the king is law, so in free countries the law ought to be king; and there ought to be no other. But lest any ill use should afterwards arise, let the crown at the conclusion of the ceremony be demolished, and scattered among the people whose right it is.

The conferring members being met, let their business be to frame a Continental Charter, or Charter of the United Colonies; (answering to what is called the Magna Carta of England) fixing the number and manner of choosing members of Congress, members of Assembly, with their date of sitting, and drawing the line of business and jurisdiction between them: always remembering, that our strength is continental, not provincial: Securing freedom and property to all men, and above all things the free exercise of religion, according to the dictates of conscience; with such other matter as is necessary for a charter to contain.

Thomas Paine, Common Sense

The most plausible plea, which hath ever been offered in favor of hereditary succession, is, that it preserves a nation from civil wars; and were this true, it would be weighty; whereas, it is the most barefaced falsity ever imposed upon mankind. The whole history of England disowns the fact. Thirty kings and two minors have reigned in that distracted kingdom since the conquest, in which time there have been (including the Revolution) no less than eight civil wars and nineteen rebellions. Wherefore instead of making for peace, it makes against it, and destroys the very foundation it seems to stand on.

The contest for monarchy and succession, between the houses of York and Lancaster, laid England in a scene of blood for many years. Twelve pitched battles, besides skirmishes and sieges, were fought between Henry and Edward. Twice was Henry prisoner to Edward, who in his turn was prisoner to Henry. And so uncertain is the fate of war and the temper of a nation, when nothing but personal matters are the ground of a quarrel, that Henry was taken in triumph from a prison to a palace, and Edward obliged to fly from a palace to a foreign land; yet, as sudden transitions of temper are seldom lasting, Henry in his turn was driven from the throne, and Edward recalled to succeed him. The Parliament always following the strongest side.

This contest began in the reign of Henry the Sixth, and was not entirely extinguished till Henry the Seventh, in whom the families were united. Including a period of 67 years, viz., from 1422 to 1489.

England, since the conquest, hath known some few good monarchs, but groaned beneath a much larger number of bad ones, yet no man in his senses can say that their claim under William the Conqueror is a very honorable one. A French bastard landing with an armed banditti, and establishing himself king of England against the consent of the natives, is in plain terms a very paltry rascally original. It certainly hath no divinity in it.

Of the various forms of government which have prevailed in the world, an hereditary monarchy seems to present the fairest scope for ridicule. Is it possible to relate, without an indignant smile, that, on the father's decease, the property of a nation, like that of a drove of oxen, descends to his infant son, as yet unknown to mankind and to himself; and that the bravest warriors and the wisest statesmen, relinquishing their natural right to empire, approach the royal cradle with bended knees and protestations of inviolable fidelity? Satire and declamation may paint these obvious topics in the most dazzling colours, but our more serious thoughts will respect a useful prejudice, that establishes a rule of succession, independent of the passions of mankind; and we shall cheerfully acquiesce in any expedient which deprives the multitude of the dangerous, and indeed the ideal, power of giving themselves a master.

In the cool shade of retirement, we may easily devise imaginary forms of government, in which the sceptre shall be constantly bestowed on the most worthy, by the free and incorrupt suffrage of the whole community. Experience overturns these airy fabrics, and teaches us that, in a large society, the election of a monarch can never devolve to the wisest, or to the most numerous, part of the people. The army is the only order of men sufficiently united to concur in the same sentiments, and powerful enough to impose them on the rest of their fellow-citizens: but the temper of soldiers, habituated at once to violence and to slavery, renders them very unfit guardians of a legal or even a civil, constitution. Justice, humanity, or political wisdom, are qualities they are too little acquainted with in themselves, to appreciate them in others. Valour will acquire their esteem, and liberality will purchase their suffrage; but the first of these merits is often lodged in the most savage breasts; the latter can only exert itself at the expense of the public; and both may be turned against the possessor of the throne, by the ambition of a daring rival.

The superior prerogative of birth, when it has obtained the sanction of time and popular opinion, is the plainest and least invidious of all distinctions among mankind. The acknowledged right extinguishes the hopes of faction, and the conscious security disarms the cruelty of the monarch. To the firm establishment of this idea, we owe the peaceful succession, and mild administration, of European monarchies.

Some writers have so confounded society with government, as to leave little or no distinction between them; whereas they are not only different, but have different origins. Society is produced by our wants, and government by our wickedness; the former promotes our happiness positively by uniting our affections, the latter negatively by restraining our vices. The one encourages intercourse, the other creates distinctions. The first is a patron, the last a punisher.

Society in every state is a blessing, but government even in its best state is but a necessary evil; in its worst state an intolerable one; for when we suffer, or are exposed to the same miseries by a government, which we might expect in a country without government, our calamity is heightened by reflecting that we furnish the means by which we suffer! Government, like dress, is the badge of lost innocence; the palaces of kings are built on the ruins of the bowers of paradise. For were the impulses of conscience clear, uniform, and irresistibly obeyed, man would need no other lawgiver; but that not being the case, he finds it necessary to surrender up a part of this property to furnish the means for the protection of the rest; and this he is induced to do by the same prudence which in every other case advises him out of two evils to choose the least. Wherefore, security being the true design and end of government, it unanswerably follows that whatever form thereof appears most likely to ensure it to us, with the least expense and greatest benefit, is preferable to all others.

Edward Gibbon, The Decline and Fall of the Roman Empire

If a man were called to fix the period in the history of the world, during which the condition of the human race was most happy and prosperous, he would, without hesitation, name that which elapsed from the death of Domitian to the accession of Commodus. The vast extent of the Roman empire was governed by absolute power, under the guidance of virtue and wisdom. The armies were restrained by the firm but gentle hand of four successive emperors, whose characters and authority commanded involuntary respect. The forms of the civil administration were carefully preserved by Nerva, Trajan, Hadrian, and the Antonines, who delighted in the image of liberty, and were pleased with considering themselves as the accountable ministers of the laws.

In the purer ages of the commonwealth, the use of arms was reserved for those ranks of citizens who had a country to love, a property to defend, and some share in enacting those laws, which it was their interest, as well as duty, to maintain. But in proportion as the public freedom was lost in extent of conquest, war was gradually improved into an art, and degraded into a trade. The legions themselves, even at distant provinces, were supposed to consist of Roman citizens. That distinction was generally considered either as a legal qualification or as a proper recompense for the soldier; but a more serious regard was paid to the essential merit of age, strength, and military stature. In all levies, a just preference was given to the climates of the North over those of the South: the race of men born to the exercise of arms was sought for in the country rather than in cities; and it was very reasonably presumed, that the hardy occupations of smiths, carpenters, and huntsmen , would supply more vigour and resolution than the sedentary trades which are employed in the service of luxury. After every qualification of property had been laid aside, the armies of the Roman emperors were still commanded, for the most part, by officers of a liberal birth and education; but the common soldiers, like the mercenary troops of modern Europe, were drawn from the meanest, and very frequently from the most profligate, of mankind.

That public virtue which among the ancients was denominated patriotism, is derived from a strong sense of our own interest in the preservation and prosperity of the free government of which we are members. Such a sentiment, which had rendered the legions of the republic almost invincible, could make but a very feeble impression on the mercenary servants of a despotic prince; and it beame necessary to supply that defect by other motives, of a different, but not less forcible nature; honour and religion. The peasant, or mechanic, imbibed the useful prejudice that he was advanced to the more dignified prfession of arms, in which his rank and reputation would depned on his own valour; and that, although the prowess of a private soldier must often escape the notice of fame, his own behaviour might sometimes confer glory or disgrace on the company, the legion, or even the army, to whose honours he was associated. On his first entrance into the service, an oath was administered to him, with every circumstance of solemnity. He promised never to desert his standard, to submit his own will to the commands of his leader, and to sacrifice his life for the safety of the emperor and the empire. The attachment of the Roman troops to their standards was inspired by the united influence of religion and of honour. The golden eagle, wihch glittered in the front of the legion, was the object of their fondest devotion; nor was it esteemed less impious than it was ignominious, to abandon that sacred ensign in the hour of danger. These motives, which derived their strength from the imatgination, were enforced by fears and hopes of a more substanial kind. Regular pay, occasional donatives, and a stated recompense, after the appointed time of service, alleviated the hardships of the military life, whilst, on the other hand, it was impossible for cowardice or disobedience to excape the severest punishment. The centurions were authorized to chastise with blows, the generals had a right to punish with death; and it was an inflexible maxim of Roman discipline, that a good soldier should dread his officers far more than the enemy. From such laudable arts did the valour of the Imperial troops receive a degree of firmness and docility, unattainable by the impetuous and irregular passions of barbarians.
